By booking a test, making a payment, or otherwise using our Service, you ("User," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Nature of the Service
OncoVeryx™ is a multi-cancer early detection screening test based on blood-based biomarker and metabolomic analysis. It is a screening aid and does not constitute a clinical diagnosis. Results must be interpreted by a qualified physician, and any abnormal or positive finding should be followed up with appropriate confirmatory diagnostic procedures. Medivexa does not provide medical advice, diagnosis, or treatment through this Service.
2. Booking and Payment
- All bookings are confirmed only upon successful payment through our payment gateway partner, Razorpay.
- Prices displayed on the website are inclusive of applicable taxes unless stated otherwise, and are subject to change without prior notice for future bookings.
- You are responsible for providing accurate personal, contact, and billing information at the time of booking. Medivexa is not liable for delays or errors arising from incorrect information provided by you.
- Payment confirmation will be shared via email/SMS/WhatsApp along with your booking reference.
3. Payment Gateway — Razorpay
Payments on medivexalabs.com are processed through Razorpay, a RBI-authorised third-party payment aggregator. By making a payment, you also agree to Razorpay's terms of service and privacy policy, in addition to these Terms. Medivexa does not store your card, UPI, or net-banking credentials; these are handled entirely within Razorpay's secure, PCI-DSS compliant environment. Medivexa is not responsible for any delay, failure, or technical error caused by Razorpay, your bank, or your payment instrument issuer, though we will assist in good faith in resolving such issues.
4. CANCELLATION, REFUND, AND TRANSFER POLICY
Please read this section carefully before booking. By completing payment, you expressly acknowledge and accept the following:
- NO REFUND: Once a booking is confirmed and payment is made, the amount paid is strictly non-refundable under any circumstances, including but not limited to change of mind, inability to attend the appointment, or dissatisfaction with the booking experience.
- NO CANCELLATION: Bookings, once confirmed, cannot be cancelled by the User. Medivexa reserves the right to cancel a booking in exceptional circumstances (e.g., medical contraindication identified during sample collection, suspected fraud, or operational reasons), in which case Medivexa's sole liability shall be limited to offering a rescheduled appointment.
- NO TRANSFER: A booking is non-transferable. It cannot be transferred, assigned, or gifted to another individual, another test, or another date-and-location combination outside the rescheduling process described below. The test must be availed by the individual named at the time of booking.
- RESCHEDULING PERMITTED: Rescheduling of the blood test appointment to a different date and/or time is permitted, subject to slot availability and any rescheduling request window communicated at the time of booking or on the website. Rescheduling requests must be raised through the contact channel specified in Clause 11 of these Terms, with reasonable advance notice. Medivexa reserves the right to limit the number of times a single booking may be rescheduled.
5. Sample Collection and Reporting
- Sample collection will be conducted by Medivexa's own trained phlebotomy personnel at the location and time slot confirmed at booking.
- You are responsible for being available, fasting (if instructed), and following any pre-test instructions communicated to you. Failure to do so may require rescheduling and could affect sample quality or result accuracy.
- Test reports will be delivered within the timeframe communicated at the time of booking. Reporting timelines are estimates and may vary due to laboratory or logistical factors beyond our control.
- In the rare event that a sample is rejected due to quality issues (e.g., haemolysis, insufficient quantity), Medivexa will offer a complimentary re-draw; this does not constitute a refund event and the no-refund policy in Clause 4 continues to apply.
6. User Obligations
- Provide accurate, current, and complete information during booking and sample collection.
- Not misuse the Service, website, or payment systems, including any attempt at fraudulent payment or chargeback without valid cause.
- Use test results responsibly and in consultation with a qualified medical practitioner.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Medivexa's total liability arising out of or relating to the Service, whether in contract, tort, or otherwise, shall not exceed the amount actually paid by you for the specific booking giving rise to the claim. Medivexa shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of profits, medical decisions made in reliance on screening results without confirmatory diagnosis, or emotional distress.
8. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. While Medivexa uses validated laboratory methodologies and AI-based analytical models, no screening test, including OncoVeryx™, can guarantee the absence of cancer or the complete absence of false positive or false negative results. Medivexa makes no warranty, express or implied, regarding the clinical outcome of any individual user.
9. Intellectual Property
All content on medivexalabs.com, including the OncoVeryx™ name, logos, text, graphics, and underlying technology, is the property of Medivexa Healthcare Private Limited or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and health information, including data shared with our payment partner, Razorpay. The Privacy Policy is incorporated into these Terms by reference.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Subject to applicable consumer protection law, any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts at Howrah, West Bengal, India.
12. Amendments
Medivexa reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Effective Date." Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
